It's a combination that she networked her ass off outside of NijiEN's sabotaging her even if she didn't get any promotional deals from it, built up massive good will from the community so her fans would be loyal to her and not Nijisanji.

But they would go after you if you are a big indie. Corpo's like Niji and Holo thou, are massive and make a lot of money, so they will have all the attention from those companies and their legal team. And is not even just the JP companies. There are plenty of Asian and Western companies that take advantage of JP law. For example, Rockstars, gave permission to Hololive to play GTA5 but only without monetization.
