Because Twitch is built entirely off rights holders turning a blind eye to copyright infringement. Even ignoring ROMs, do you really think all of these game streamers actually acquired the rights needed to stream the game they are playing? No, they don't.

The majority of youtube and twitch is legally copyright infringement that copyright holders aren't prosecuting. Only a minority of games actually have explicit rebroadcasting licenses. Everyone touts fair use but fair use is actually rather strict and meant for criticism, not just rebroadcasting the game as it is. And even if you think your usage falls under fair use, you have to defend yourself using that in court, and likely won't make it that far because it costs buttloads of money to defend yourself against a major corporation.
There's always cases of people suddenly getting struck by companies who decided they're gonna stop turning a blind eye and for a company whose entire income is based on that it's very risky.
