I would think neither could sell the artwork without contractual agreement by both parties. If he's selling it that seems to be illegal. If he's just listing it as an example of his work it's legal by default unless their contract stipulated otherwise.

That is, unless they reached some agreement to put it for sale on this con (which obviously wasn't the case), and even if that were the case, the money would go to her since she essentially now owns anything related to that artwork.
