Nah, Niji's always been careful over it. In fact one of the criticisms people had when Hololive lost all those streams to permissions was "They should've known better, their main peer in the industry has already taken care of this."
Unmonetized streams are usually them asking for them and the company telling them "You can stream, but no superchats".
The Hololive thing is
1. They're less proactive about getting those permissions when their talent ask for them
2. Sometimes they won't take a "Yeah you can stream this, we don't care" in the terms of use as enough.

The main problem is they can't afford to pay established VAs to stream full time. Although a lot of characters were voiced by literal whos but perhaps they don't have the ability to be a entertaining streamer.
And they can't replace the original VA without pissing off a lot of people. That's why they had to create a new gaming fox instead of using ezo red.

That's true too of course, but I think even then it's just better not to mess with those characters and take the ones that haven't really been used for anything. Not just for VA matters, but also for the characters themselves.
The ones with less established personalities can act as more of a blank slate for the streamer to fill in with some loose guidelines
