TL;DR: Contract clauses don't necessarily exist to win cases, they can exist to make muddy cases in such a way that a lawsuit becomes non-viable. Contract law is an incredibly complicated topic and there isn't really a great way to do summaries especially when clauses tend to depend on other relevant laws and specific circumstances, but it's a mistake to think "if it goes to court" is the right way to look at a contract. I do not see these two things happening at all. The first one hasn't really changed NijiEN's CCV much, if anything Enna's viewership went down during her two special planned events compared to last year, same for her superchat donations. And because NijiEN may not be welcomed at North American cons for a good while, and assuming they actually plan on blacklisting people, that's only going to hurt their own growth long term as they'll be isolated from the great English scene. The only hope for growth will be for those NijiEN talents that can stay out of drama, but even then NijiEN hasn't been growing since Krisis either.

The other thing is that they can try and sue people for defamation, but it just won't work. They tried that for Roa in Japan, where defamation cases are an easy slam dunk, and yet they still lost because the judge saw that she was still making money via voice packs and realized "Well, she isn't that affected if she's still part of the company after 2-3 years". If they can't even win a case in their native homeland, what hope do they have of navigating international laws and successfully suing other talents/drama vtubers under defamation?

It's pretty standard operation for companies. They will do anything they can get away with until a court forces them to comply with the rules. The main thing these companies do is make things at obtuse as possible so people don't bother trying to get the things they're entitled to.

A common example where I live is companies need to pay travel expenses for their employees who travel more than 10KM to get to work. The vast majority of companies will not actually pay your travel expenses unless you go out of your way to expressly insist they pay you. And then they still don't pay you. Request again and they'll say they'll pay you, and then still won't pay you. Go to court and you lose thousands of dollars on a lawyer to get much less than that in travel expenses and your contract isn't getting renewed. Some people in Nijisanji are lower 3views now, she didn't get to the viewership she had or kept it as high as it was by being bad at her job. She's a good entertainer that's good at her niche. She won't get the massives boost Doki got or begin with mythical numbers, but she can pull enough people for a comfortable start of her indie career. From then on a gradual incline is not out of the question. Not the best example, but Sayu restarted relatively small and she was strongly inclining, even before this situation exploded (when she started getting big subs).
