People have been uploading and streaming game footage without permission for closing in on two decades now.

This matter was done and over with for years before vtubing even started. We had the monetization wars with Nintendo carpet-bombing copyright strikes in like 2007.

The only potential complication is that the agency as a corporate entity profits from this footage, which does not apply to VShojo as they don't take any cut from on-stream earnings.
However even then, there have already been several companies employing LPers, reviewers, livestreamers, etc. where game permissions just... weren't even part of the conversation.

To give a recent example, Chiyomaru Shikura personally copystruck Minase Rio's stream because he thought the latter had gone overlong even though Holostars had specifically gotten long stream permissions from Chiyomaru's very own company.
Since Holostars were in the right and had permissions in writing, Chiyomaru and his company had to apologize and retract the strike.
