Mmm, no they actually did have the room for it if they were vague enough.
They could have done something like -

Nothing explicit, but people would know what it's about, and respond accordingly.
They had a pretty solid ground for suspensions because Nijisanji livers and accounts are THEIR IP, and creating a separate discord server without management oversight can be considered as abuse of IP and non-cooperation. It's very likely to be contract-enforceable as well.
It would have avoided future talents getting waaay off the leash as well, since public suspensions (instead of secret ones) are a decent punishment, wherein the fanbase will watch and see whether the liver improves their behavior or not.

Trouble is, it would "expose" their livers doing stupid shit to a much bigger crowd, so they'd have to tank a lot of short term hate for long term goodwill.
They decided to bet on the short term, but the leak found it's way outside of /vt/ anyways, and now they're getting hit by the long term snowball consequences of it all.
