I hope so, but i imagine he can still just comply with ksons video removal at least, wont that reverse the strikes? Or possibly fight the claims, if he can prove some transformative nature, i cant recall the details, but 30 seconds is about as much as you can take freely to reuse for your own creations, as long as its not the parasitic music industry or disney that is.
