A trademark is like a logo, you cannot copyright the words themselves, only in a specific context.

You could still create your porn epic "Suck it down - The reckoning - This time it's personal" (unless they registered it for that case too, though I am not sure if you keep a trademark for a case if then don't really use it, like for movies and then never actually bring out one)

But you could not use it as a tagline for your video game and especially your company

To be fair, the game's appeal was that it was hard as fuck and never gives you a break in action. The problem is that "Rythyhm Game were a Japanese family has a series of WaCkY adventures" wasn't something that was going to appeal to normie Westerners at the time. Hell, look at the ads for Tomba or Goemon around then; the only thing marketing could come up with was 'they have eon colored spiky hair and its WEIRD'.
