Not really plagiarism, but clearly heavily referenced. I imagine game cover/promo artists were under a big time crunch and probably not given a huge payout/budget per piece, so they made due with what had. It wasn't as easy to get varied reference back then plus they probably didn't want to pay a model to pose or buy props for reference, so maybe stuff like movie promos and magazines were the best they had to use.

It was the 80s and video games were stupid kid's shit. They're still stupid kid's shit, just multi-billion dollar kid's shit, so it's different these days. Plus as >>7974401 points out, you'd have had to do some legwork and it wasn't worth it. Totally different world before everybody had internet. If you're only in your early 20s or younger then you really won't understand, barring a specific upbringing.

If you look through classic games then you will find countless ripoffs. It's actually pretty hard to sue for likeness appropriation and win, however, so that's one way they get away with it in the US. The person in the video/whatever basically has to say "my name is (real person's name) and blah blah blah" (as well as mimic likeness and famous actions) for it to be a winnable case. Otherwise you wouldn't be really able to represent famous people in media much at all, one person would sue hard and it would all go away.

Funnier part for metal gear is that on top of the traced/copied box art, the character face sprites in-game are all lifted from real actors too. Snake is Kurt Russell, Colonel is Dick Crenna, etc. Kojima gave no fucks about putting his favorite actors right in the games. Lifted tons of famous names too (Ultravox for example).

So, when I had Michael Beihn sign my copy of Metal Gear, I asked him if he was aware of the plagiarism back when the game came out. He didn't really answer the question, but he decided to give me a rundown of how plagiarism works. He said, in his own words "anybody can copy my image from the neck down. That's okay. In cases of plagerism, only the face is protected, and I would have to prove that the face and face alone was a copy of mine."

Perhaps, however, the photographer would have a case for plagerism, but thats if the studio didn't own the rights to the photographer's work. They most likely do.
