That's an interesting point for sure...

I do believe the overarching message, however, is an argument against the soul-draining of nihilism.
Look again at the end. Look at how The Kid, when in the same building of the judge, teases with corruption again by wanting to fuck that dwarf prostitute. He doesn't. He can't get it up. He goes down for a drink. This, as most believe, is the final way in which The Kid rejects the evil influence of The Judge.
The Judge, knowing he's been relegated to nothing in The Kid's world, does what any childish force would do: destroy which it can't claim.
The dance The Judge does at the end is nothing more than a childish display of arrogance. Notice how McCarthy repeats the phrase "He says he will never die."
He says he will never die. Not "he will never die." It's based in his subjective, constricted view of the world.

I believe that The Kid really did triumph over The Judge. Take a look at this draft page. The Kid clearly triumphs over The Judge's influence.

He says he'll never die. Says. He kills the Man because he failed to convert him to his side. This was a tacit recognition of defeat, of something outside his system which he could neither control not extinguish -- the human spirit. His ending dance is a simple act of childish hubris.

Take a look at this draft page. The Judge can't "whip" the Kid, ie make him obedient / control his will/spirit. He can only destroy his physical body in frustration.

I think you're wrong, but I don't speak post-modern so maybe I'm misinterpreting you. Genuine assimilation implies the Judge has a totality of control. That he can simply choose whenever he likes to force the Kid/Man to join his system. But he does not, and cannot. And that is precisely why he struggles to dominate the world and root out treachery and hidden things. He kills the Man not to assimilate him but as a tacit recognition that the Man's resistance, which was always a disappointment to the Judge, has become intolerable. Check this page from an early draft of the book. The Judge can't "whip" (ie, control/enslave) the Kid, only kill him.

Whole lotta y'all think you smart cuz you read philosophers. Anyone else find that they're familiar with 99% of popular philosophical concepts without having being introduced to them? As far as I'm concerned, philosophy's a natural process, 'nd texts on it usually do little more than present some jargon-laden way of having philosophical pissing contests.
