This is an amazing trick that Rand does where everybody agrees that her characters are wooden and obvious and have no subtlety, and yet they can't identify what anything they do means or what Rand is doing with them.

The point of Toohey's character is that her always does the kind thing instead of the just thing, and that people think he's moral for this. But kindness is a morally neutral trait, that can be done out of benevolence or as a kind of poison. Enabling, basically. Toohey always does generous, self-sacrificing things that make people worse off while making them feel grateful to him, like they owe him something. A fairly common type of person, that you never see as purely consistent and self-aware as this in real life.
Yes, he got that guy out of jail. But he did it with a comment about not creating martyrs that in effect meant 'nothing you've done here matters', then sent him off into a life of destitution and hopelessness. And the stays that way, until Roark shows up and offers him a different kind of happiness.

That's what your missed. Toohey, who is considered selfless and caring, is kind to what's weak and insecure in people, and so empowers those things. Roark, who is selfish and harsh, is kind, when he is, to the strongest, most reverential parts if people, and so empowers those things.

I don't know about you, but I call that good characterization.
