The German snack you're thinking of, while similar, also has some differences. Pocky is a stick of bread dipped in chocolate; what I assume you're referring to (Bogdons 'Reception Sticks') is a stick of candy dipped in chocolate.

Considering how many products and inventions are inspired by (or simply modified versions of) previously created things, it's easily debatable as to whether or not it could be considered stolen.
