Hey, /jp/

So, I've recently been wondering about one thing concerning Comiket. If I am correct, various doujinshi artists are selling their works there, for example the drawings of Touhou characters. How come, they can make profit off copyrighted characters? What are the legal rights concerning this matter? Can they just draw any character they want, and nobody complains about it?

Also, is there any specific content that is prohibited (for example some excessive children cruelty or something)? Do they verify IDs of anyone who wants to buy the adult only books?

If anyone feels like explaining those thing to me, thanks in advance. Pic related.

The thing is, Japan doesn't have a sandy vagina or a tight ass about these kinds of things, the only place you'd find people whiny and shallow enough to actually complain about that kind of thing is the U.S.A.

If I remember correctly, tripfag, the copyright laws in Japan are extremely liberal. As long as you give credit to the source and don't claim you created the characters, you can get away with practically anything as far as derivative works goes.

This, and also because the companies recognize that new talent for the industry can eventually be found amongst the artists at Comiket, so they're basically keeping their industry alive for longer by not killing off these new artists. Unlike what they do in America.

Japanese copyright law has a loophole for what's considered personal creations. So, if you make a derivative work that has a very small run, you're typically fine. This covers most stuff at Comiket.

Of course, if it's Touhou, ZUN has basically said as long as you don't totally crap all over his creations he doesn't care what you do.

There are instances of some derivative works which were eventually shut down by the original creators because they got way too big. Doraemon Final Episode is one that comes to mind.

It's just that everyone looks the other way; it's the accepted attitude to have. Yes, The Man can easily shut down Comiket, but he never will because that would be in poor taste.

It's a very Japanese attitude indeed.
