That particular videos links to the original song which properly credits Shibayan for writing the song. In our current case, some nameless guy copy pasted Shibayan's song, did what any 5 year old could do which was copy paste drum beat and a quote from hokuto no ken and then claimed that the song was his. He licensed a song that someone else made. This is a literal attack on the doujin circle. I am completely baffled as to why there isn't any lawsuit it would be such an easy victory. Worst part is these people don't even know what Touhou is.

で、その記事にある通り、結果tiktokでミームソングになってしまったので、恐らく今後も次々と他の人が勝手に配信する事が予想されます。この曲単体をどうにかする事を考えてもしょうがないから、その先を考えなければなりません。調べた所ミームソングになる前から合計3人が配信しているようでした。

(youtubeの無断転載動画に付いていたcontent idから逆に追って調べて分かるような範囲で3人という事なので、実際どのプラットフォームにどのくらいあるのかは不明です。

You guys may have heard of deadman, the guy who "remixed" and licensed a Touhou song from Shibayan Records called Tiny Little Adiantum to a commercial music publisher named United Masters. The name of the remix is deadman 死人 - Omae Wa Mou by the way

Deadman's remix by the way is essentially adding in the trademarked catchphrase of Kenshiro from Fist of the North Star "Omae Wa Mou Shindeiru" and a simple drum beat loop while modifying nothing else from the original Tiny Little Adiantum song.

Apparently, this guy never heard of copyright infringement because checking out his youtube channel, you have to wonder the balls of this guy to "sample" music from Undertale and even Evangelion and under the video description, mention if you want to purchase the "beat", please message him.

Anons saying this are doomsayers but if we're going to be brutally honest here, it's a pretty bad thing whenever someone rips a song without person. Using samples is a pretty big part of music, but its just that; samples. Parts of a song. Far as I can tell this is pretty much just a straight rip of another song, which is kinda against that. But the problem really comes from something simple.

Popularity. Vanilla Ice got away pretty clean with just ripping the beat from Under Pressure, simply because his song was relatively popular. They settled out of court and he paid a fraction of the money he made, and this was one big name in the music industry versus living legends. The fact that he didn't go bankrupt after that says it all; even the people who are in the right can still not even be able to take it to court, even if they're leagues larger than the person stealing their work. And these are two english speakers, how far does anyone here think Shibayan will get in a legal system? I say he wouldn't even get far enough to get an out of court settlement, because that groups a foreign literal no one compared to this kid. It's not going to kill the doujin scene, but it's a pretty decent hit because it can set a precedent of just steal foreign work wholesale and just get away with it. Because what can they do? Spend money they don't have to hire a translator, money they don't have to get housing if they have to fly over, money they don't have to get a lawyer, and money they don't have to keep going through the cancerous legal systems of what I'm assuming is America for months on end?

They sell CDs at comiket. Versus the kid getting a signing with companies and making thousands right out the gate, thousands more than Shibayan already makes. Got caught by who though? I had the original song in the description for about a month before United claimed Shibayan's upload. I talked to Shibayan back in August and they didn't have a problem with it and knew about the beat a week before it was down the first time.

Fuckin how? In terms of Cannoball, allowing mobile games was inevitable due to how much the Japanese love them. Japanese fans are looking forward to it, so even if you aren't its not like the game is being made with you in mind anyway. In terms of this whole debacle, you cannot seriously tell me that you're going to begrudge ZUN for not doing anything when he probably isn't even aware of the situation and/or doesn't understand what exactly is going on. Same for Shibayan. Shibayan also probably wasn't aware of the weight the decision to let them use the song had and even still might not understand just how out of control it has gotten. Regardless though, the Japanese fanbase doesn't seem to really care because a Touhou thing became popular and they're happy with that. A Touhou song getting remixed and becoming popular in the west is not going to influence circle at all (if anything in might encourage them). If, for some reason, theft of Touhou doujin music did ramp of from this (which is actually pretty doubtful, given the lightning in a bottle this situation was), doujin circles and ZUN would absolutely start doing something about it. Sorry, ZUN has no right to sue deadman and deadman doesn't need to follw touhou's rules.
This is how copyright works: if someone use your work in his own work with your permission and following your rule, then you hold the right of the specific part he use your works and the rest belongs to him (which means he can license it as long as it's not against your deal).

The inter was the only part that Shibayan used yuuka's theme (which ZUN hold his right) but deadman didn't sample it.

There is a reason why Toby Fox of Undertale eventually released copyright guidelines when pretty much he was trying to be even more lenient than ZUN but it backfired because American fanbases are less respectful than Japanese fanbases and their greediness caused Toby Fox to finally release copyright guidelines for Undertale back in 2016.

It feels like Shibayan underestimated Deadman and Lil Boom and how far the two were willing to commercialize and did not do enough research by checking their YouTube channels for example and realize Deadman and Lil Boom, appear to have a history of copyright infringement and long time due for a channel termination by Youtube, and it would be best to just not associate with those people at all and politely decline their appeals against their copyright strike.
