The main thing I've always had against the 4chan pass is that it provides a solution to an issue that moot invented. We used to be able to post without having to solve captchas. moot added captcha to fix a few issues with spambots. But here's the issue I have with that.

1) The spambots were never that big of an issue. Out of all the spammers only one guy took it too far and I dare not say his website because it is probably autobanned.
2) There were other ways to stop spam bots. You could have created a free, anonymous, trust-based login system. A system where people who have a track record of not spamming could post without the captcha. And no, a login page would not have changed 4chan's culture in any way. (Login systems have nothing to do with, avatars, sigs and post counts). Users who didn't want to login could keep solving the captchas.
3) 4chan Pass isn't a good enough feature to warrant paying for it. Users who joined the website in 2005 were used to posting without captchas. You can't take away functionality and then make them pay to get it back. It's the equivalent of Hiro making us wait an hour between our next post then asking us for money to get back our old posting speeds.

Another thing that is odd about Jim's hostile takeover is the reaction of the 2ch community. They seem to be posting like nothing bad happened. If someone did a hostile takeover of 4chan the community would rebel. I know this from personal experience. Many moons ago 4chan's DNS got hijacked. They redirected the domain to their forum (pic related). I along with many old /a/ anons rebelled against them. Some even took it to the extreme and spammed said forum with CP. I think AoRF was spamming them with a script.

I know that Japanese culture is different from western culture, but don't you think they would have an issue with Jim if he stole the website as Hiro claims. 4channers don't love moot but they definitely wouldn't stand for a hostile takeover.

In summary, Hiro was trying to regain control over 2ch.net from Jim Watkins under a cybersquatting regulation. The case was decided by an executive tribunal (which is different from normal legal proceedings before an open court).

In order for Hiro to succeed against Watkins, he had to prove all of the following: (this is under Header 7. Discussion and Findings)

1. that 2ch was his trademark, and that the URL could be mistaken for his trademark;
2. that Watkins (as the registered owner of 2ch.net) had no right to use a URL that conflicted with Hiro's trademark; and
3. that Watkins was using the URL knowing that he did not have the rights to do so, with the intention of extorting Hiro.

1. Hiro succeeded on the first point since he did have a trademark over 2CH, and because 2ch.net could be mistaken for Hiro's trademark.
(Note that Hiro only registered the trademark on April 22, 2016, when he claimed he was owner of the business since 1999. The tribunal proceeding were only initiated around May 2016, so the tribunal was probably suspicious. >>15928529's suspicions are correct, Hiro didn't register 2ch until this year.)

2. Hiro failed on the second point because he could not prove that Watkins had no right to use the domain. This is odd, because Hiro didn't really have to prove that much; the burden of proof on him on this point was “relatively light”.

The problem is that Hiro didn't provide any evidence to prove that Watkins was squatting on the domain name: Hiro didn't prove that he was operating a business under the 2ch trademark, or that he had better rights to the trademark than Watkins. (I don't into intellectual property law so I can't tell you why or how this works)

Hiro also tried to include an email between him and Watkins as evidence. Under Headers 3 and 4, the tribunal refuses to admit the evidence and gives its reasons there. It's a bit procedural so we'll ignore that. However, the tribunal found that even if it had considered the email, Hiro still would have failed since it's unclear what the email meant:

>"Even if the Complainant’s supplemental filings were taken into account, the Panel would still conclude that the Complainant had failed to satisfy paragraph 4(a)(ii) of the Policy. Whilst there may be a possibility that the Respondent is holding the Disputed Domain Name on behalf of the Complainant, and the Complainant “entrusted” the Respondent to operate the “2channel” business on behalf of the Complainant, insufficient evidence has been provided. The email dated April 30, 2012, which was provided by the Complainant as part of his supplemental filings, merely states that the Respondent agreed to “change this to what you want, after this ordeal is over”. It is not clear what such agreed change was, and the email provides no concrete evidence of the alleged business arrangement between the Parties regarding the Disputed Domain Name."

Finally, the tribunal though that Hiro's dispute with Watkins was not a cybersquatting dispute, and more of a business dispute. Since the tribunal isn't really qualified to handle business disputes (it does have not enough procedural safeguards in place, or enough legal expertise), it suggested that Hiro should bring his case in open court instead.

3. Since Hiro failed to prove point 2, the tribunal didn't consider point 3 to save everyone's time.

The tl;dr is Hiro failed to repossess 2ch under this cybersquatting regulation, and is now probably trying to challenge Watkins in open court, which may explain why he's jewing for shekels now.
