It isn't. Look up the copyright law. Its for use of it isn't commercial. However because he is selling a course, that makes it commercial, so he needs to have the artists written permission to use their work in his ads. At my school when they wanted to use our studies as examples and put them on the website and brochures, we actually had to tell them yes or no, and if yes, sign a document stating that were giving them rights to use it in advertising for the school.

So its actually illegal for him to do. Someone should contact the artist about it and ask if he paid for commercial rights for using their work.
