Don't mention anything about the tear/damage, just say he sent you an empty box or a totally different pair of shoes. IF you didn't have to sign for it, say you never received anything. Yes.
I've had the Lanvins since April 2011 and they are still wearable today.
The soles is thick and deteriorated at a slower pace than my CPs have. (~7 months of wear and some gnarly heel drag)
All in all, the lanvins are more durable and high fashion, but are less comfortable and functionable than the common projects. So really up to you.
