My bros and I are starting a clothing line thats been yrs in the production. Now that we have enough spedning money we finally have got some things done. We got a couple shirts done and bunch of designs saved to use on our screenprinter.
I was tasked with the legalities.

Unfortunately our brands name is rather generic, meaning its an everyday phrase for privacy purposes lets call it "Big Boned". It is indeed common and therefore would be harder to copyright/trademark???

Basically I want to make everything officially/legally ours. If not the actual name then the logo we have setup.

I dont want to get ripped off or have our ideas stolen due to poor service.
I.e. cheap mexican insurance that just happens to go out of business when one of their clients actually gets into a wreck.

Can some of you fine gentlemen point me in the general direction?

Then, register a trademark through the US Patent & Trademark Office for a Federal trademark.

not a lawyer, but did negotiate trademarks, ran large business, etc.

you can copyright/trademark "marks" eg. your brand, and in certain aspects your images you screen on.

marks (eg. trademark) can be generic-sounding "big boned clothing, etc) but has to be unique -- no one else using it.

it takes literally years to complete a trademark, you absolutely wont complete it without a lawyer, invovles searches, etc.

but clothing designs themselves cannot be protected. nike swooshes etc sure (marks) but not big collars, baggy sleeves/legs, that sort of thing. you can't own "blue" or patterns etc.

none of that matters, because fashion comes and goes soo fast you'll be in and out of business before competitors could do any of this shit either. like music, your advantage in being small is you can move fast.

if all you are doing is silkscreeing t-shirts with unique designs, then just stfu and do it, get stuff out there, be quality, etc.

to be harsh for a moment, is all this legalistic crap for ego? if it really takes you and a couple of friends "years" to make designs, you're dead anyway.

yup, you got it. your big advantage is SPEED! maybe do a batch paying someone else to screen them. while a pro silkscreen setup is affordable ($1000 for 4 colors, etc) do you really want to worry about quality, reliability, working out how to screen etc at the same time working out designs and distribution?

i would guess that SELLING will be harder, and yuo wont make money at first (totally normal) and you will have all sorts of little piddly shit that will distract you at first.

pay a pro shop to screen your first batch(es) so you can concentrate on the rest.
