It depends. If you want to produce and sell it in large quantities - you will get lawsuit as soon as you put it up for sale. If you build one (or few) for yourself, or friends or even made one for someone (and get payed for that) - you will get away with that. Well, latter is still kinda illegal, I guess, but who would find out about it?

why not just install an android os onto your psp? I have a japanese psp-1001 that I softmodded straight out of the box, that would be a pretty nifty mod.

It's made in china. Who also make Land Rovers, Bentleys, Chryslers etc without the patents, just stolen. The chinese courts wont klet them be sued in china, and thats where they are sold - the company itself doesn't export them, so Sony can't sue.
