There's an exception written into the Canadian national dairy code regarding the blanket prohibition on sales of raw dairy that specifically allows raw cheese curds to be sold and consumed on the day they're made. Otherwise, they need to be cold aged for 30 days before that can be sold.

98% of the time, you're probably getting the aged and dried out cheese curds, which isn't "real poutine" but still counts as "poutine".
