The case I heard about was one woman with a heart problem. She was not overweight. She avoided all stimulants, especially caffeine because of her heart problem. The caffeine overstimulated her heart and she died. She had no clue and Panera gave no indication that the "lemonade" contained caffeine, let alone the equivalent of 2 and a half cups of caffeine. Her family is suing Panera and the case is still pending.

Your understanding of the word "fault" is severely lacking. The restaurant created a beverage with excessive caffeine and labelled it the same as lemonade, a drink that never has caffeine. So a case can be made that Panera prevented her from making an informed decision.
