I have a supply (2 pallets worth) of old cigarettes L&M, Marbs, Camel, Winston, Salems, Kool, etc that are expired circa 2004 sitting in a warehouse. They’re all sealed, in perfect condition, and taste fine. Everyone knows about them but nobody cares and I’ve been told to take as many as I want. I quit one day randomly, just decided I wasn't going to buy another pack. I didn't smoke for like 18 months but then my shitty job started really wearing down on me and I'd just smoke one or two on the way home from work, then it was a couple on the way into work and a couple on the way home. then I started smoking on my breaks again, and before I knew it I was back to like 12-20/day. They already did a flavored tobacco ban in 2009 and explicitly excluded menthol. So the fact Congress felt the need to do that points to it being an uphill battle for anyone wanting to ban it. I'm sure a lot of people with the FDA want it banned but a lot of other influential industry representatives the FDA needs to have some level of cooperation with to get things done probably want to stop the ban even more. It's also kind of a stupid hill to die on since like the other anons have pointed out it's trivial to get menthol separately if you want to just apply it to cigarettes yourself.
Also even though the FDA can produce studies showing menthol correlated with more young smokers or other forms of worse than average addictive behaviors nobody has actually reproduced this finding with former menthol smokers who were prohibited by law from buying their preferred cigarettes. The comparisons have all been done with menthol smokers against non-menthol smokers, and I'd bet the menthol smokers aren't going to show much of any signs of improvement just because you cut off their preferred newports.
Similar to how unhealthy people don't start having lives that resemble healthy people just because you take away or add in one attribute in isolation. It's why multivitamins have been so disappointing in how little evidence has been found for them helping. A lack of some vitamin tends to matter more as an indicator someone's not taking care of themselves than it does as an easy lever you can pull to fix that person. You can predict they're going to be worse off but it isn't necessarily because of that one attribute in a direct way. Younger people or people with worse lives probably just gravitate to menthols more and will still be young or have bad lives when they're coerced by the government into buying non-menthols instead.
