Any copyright lawfags here? How do restaurants get away with pop culture references & imagery on their menu?

Pic related. Apparently there's a restaurant in England with a menu that's inspired by Rick and Morty. As cringey as that sounds, how is this legal?

Alternatively, we could just have a "pop culture references in menus" thread.

Mahony's in New Orleans actually added "Homer's Crawfish Almondine" to their menu after that Simpsons episode aired.

What would you think that would happen if a big studio were to sue a small business? The money is not worth the bad PR, people will always side with the small business over the bigger one, and for entertainment, specially, maintaining a good image is important

I also could not for the life of me find any other instances of crawfish almondine, so I think the Simpsons made up the dish, and this one restaurant decided to make it a reality.

Disney once issued a C&D order to a daycare that had their characters painted all over the building. To my knowledge, Disney didn't receive any major flak for this, but Hanna-Barbera caught word of this incident, and offered to let the daycare use their characters instead. Then again, even if Disney did catch any flak, they would be able to recover quickly, since they're so big.

don't they have to defend their copyright otherwise they lose legal control of it? Like they don't have to search out and take down every single occurrence they find, but if they are made aware of something they need to take action otherwise the knowledge of their inaction can be used against them later on

There's a driver's ed school in my city called "Roadrunner." Their mascot was literally a palette swap of the Roadrunner from Looney Tunes. They got away with it for a few years, but then they had to get rid of it. They're still called Roadrunner, but no mascot.

So I would surmise that lawsuits and cease & desists do happen, but not often. I highly doubt anyone gives a shit about the "Tom & Jerry Cafe" that I once saw when I was traveling in India.

Not a lawfag, but typically the ip holder could send a cease and desist if they care. In many cases, they don't know about it, or decide they like the free publicity rather than cause a stink about shutting it down. Possible they shake 'em down for a licensing fee or % for something to the level of this Rick & Morty cringeshop.

You get away with anything the rightsholders don't actually sue you over. This is probably over the line because they use art clearly inspired by the show.

If they just referred to the show it would probably be okay.

They could probably be sued over this, though. It's close enough to the original to create the impression that it's licensed by the showrunners. None of this applies if they actually licensed it of course.

Names, especially basic ones like that, are contextual. You only really win your case if you can claim someone is mistaking one company for the other. Since there is no relationship between cartoons and driver's ed it's fine.
There's a big Casino in my city called Crown and every time they try to sue someone they get blown the fuck out. The idiots opened business in 1994, and they act like they invented the word.

I figured they were able to keep Roadrunner as their business name, because there is an actual species of bird called a roadrunner which the Looney Tunes Roadrunner is based on. But getting rid of the cartoon mascot was more than understandable, since there was no way around that.
