Yes and no.

You can take pictures/film without consent in public places as long it isn't focused on one or more people in particular.
If it's focused on someone, you could get into trouble. Depends on the situation.

Cons can however change the rules of the space they rent. So you need to read their rules on photography, if you shoot on their (borrowed) property.

But I've never heard a con story of someone getting into trouble for filming a cosplayer (with consent) and having a few background people.

It's perfectly legal. However, convention centers and hotels are private establishments and can set their own rules. If a con wants to prohibit photos without consent then they reserve the right to ask you to leave if caught. However, most cons don't really give a shit.

the phrase you're looking for is "expectation of privacy". If you're in a public place, you have no expectation of privacy, so you don't need anyone's consent to take pics or video. does not apply to upskirts and stuff like that, obviously.

Hard and fast rule: you can take photos until someone with authority tells you to stop. You can then still take photos but if they tell you you're trespassing then you should leave.

It's really the trespassing part that you should pay attention to because that's the one that has some weight behind it.

Now, with that said, you can be in a public place and still take photos of anything publicly visible that does not have an expectation of privacy. If you really wanted to take a picture of someone's ass and you're standing on public property and they happen to be visible through the doors of a lobby your legally able to.

Really depends on where in the world you are. Where I life, If you take a picture with clearly the focus on someone, than that person get's what you call "expectation of privacy" regardless if they are on public ground.
