If you buy from a company they outsourced it to China where the people in sweat shops make next to nothing. That case was street photography though, classified as fine art. That doesn't have much to do with a cosplay photo where the cosplayer is the main subject.

In con terms, I take a photo of you, like a portrait. I can't legally sell that photo of you without your permission. Now I take a photo of you and you're in the center of a convention crowd or on a con floor. I can sell that without your permission, as you aren't the main subject of the photo, as the con floor is.

The thing you have to realize is court cases are just arguments, so it's a matter of how you use your arguments, and those from past cases, to help justify why you should be paid. In the case of photography, there's been enough cases for both the photographer and subject.

It just pisses me off when photographers who have no real experience doing the non-photography aspect of their jobs deceive cosplayers into losing their rights. There's one photographer here in MA, who loves shooting cosplayers under 18 and having them sign away their rights, but none of that is legal, as under 18, means still a FUCKING minor.

This is just dumb, plain and simple. If a photographer is going to pay for someone to shoot they can hire actual models for the price she's charging. $100 per hour is a really good income for a model either not with an agency or just started with a small one. Really experienced models from bigger agencies don't cost much more than that. Unless you have a super hard-on for this specific girl in these specific costumes, there's no reason to pay to shoot her.

But you know for some cosplayers I could see how this would be worth it. If you hire Jessica Nigri or Yaya or someone like that, someone who is well known outside of cosplay and you could make money back selling prints of then okay sure pay them a hundred bucks, get your hour and you'll make a few notes back in the end. But this chick? You're just pissing away money for nothing.

$100 per hour, actually they would. That's almost twice as much more than Pixelette pays. But they also would either demand rights to the images or they would go ahead and sell them themselves regardless so why anybody would want to work with either of them, I don't know.

They're probably only making a very small profit after they spend the money mailing it out too.
