My prediction: all ERC-20 tokens prior to regulation being passed will be safe as long as they are legitimate and the token provides a proven utility. Scam shit coins finally die (bye bye 0xBTC if you aren’t already at 0 by then). Everyone will still be able to trade as normal, just as you would be able to go out and buy stock. This is the SEC holding the position that these things were securities all along and therefore subject to the Howie test and all other securities regulations. It’s like if the government banned weed years ago, then looked the other way on weed dealers for a while while it stayed technically illegal, then suddenly decided to crack down under existing laws.

Nothing is shielded because this is not a new law or regulation, just a “clarification” of how long-standing law is interpreted by the agency in charge of enforcing it. It’s not nearly the same as Trump trying to argue something is illegal because he doesn’t like it despite a ton of established jurisprudence and legislation saying it’s legal.

There will undoubtedly be some major court cases if the SEC decides to go after ICOs of existing coins (which will argue that their products are more akin to Chuck E Cheese tokens or Pokémon cards), but the SEC position is they can do this and they do have legal legs to stand on as they take action.

This will have big repercussions for crypto in terms of removing a lot of volatility and manipulation from the market and luring in big institutional money as well as killing a ton of cryptos and making it a hell of a lot harder to start up an ICO.
