This is incorrect. If a disbursement is made to shareholders then the shorts will be exposed.
Let's suppose an example where Charles Schwab has 6MILLION real shares on hand. However, due to the looming bankruptcy they decide to start offsetting buy orders with synthetic shorts, what can happen is they may have 11million longs, 5 million naked shorts, and 6 million real shares.
Now what happens if everyone is issued 1 share of Teddy for their BBBY shares? If you were on record as a shareholder you are entitled to the disbursement. And in the case of this broker, they only receive 6MILLION shares. So how do they accomodate the fact that they still owe 5 million Teddy shares? They are now effectively short Teddy (and they never even got to collect premium to open the short!)
So what the brokers will do is look towards any retail short sellers and their accounts will show a short position in Teddy.
The remaining shares not held by retail will be on the broker. This will be extremely risky and they will want to close these positions out ASAP in dark pools before market opens and the trading public can start buying this new company. The price will squeeze automatically.
Anyone with an open short position in BBBYQ would be wise to sell everything in their margin account and withdraw their money before they get margin called. You will not survive the capital required to stop what is essentially the start of MOASS.

This is weird. If the Plan Man is having difficult with a few million in admin claims then Judge Papa screwed up BIG by allowing 40+million in prior admin claims, many of which we KNOW are for things that we HAVE NOT YET OCCURRED. I don't think Papa made such an overt error, so the more likely case is simply that Goldberg is unaware of whatever might be going on that could justify the Judge's behavior in the estate to choose 2nd highest bids for assets and hefty legal fees for reorganization work that hasn't yet become effective.
