If a government has no authority to hand out punishment, then what authority does some random asshole with zero legitimacy to rule have? A punishing authority must have legitimacy derived either through law (i.e. a citizen's right to uphold existing law) or through some other vehicle such as holding an elected office or appointment to an office by a governing authority.
