Business continuity doesn't just mean selling the same shit retard. The entire reason that the rule was put into place was to stop people buying dead shell company's just for the tax breaks. The legacy business no longer exists, having none of the business assets (including stores, warehouses, website and brands), and having fired all of their staff. The fantasy of Cohen wanting the NOL's (ignoring that the debt is higher than their value anyway) doesn't stand because the rule prevents him from buying a company just for the tax breaks if he can't prove that he was interested in continuing the business and wanted to pay for the business assets.

This isn't true in the slightest. If a disbursement is made when BBBY returns from CH11, brokers will be liquidating your margin accounts for all losses your short position incurred.
That is if you are LUCKY.

The problem is the shares were "cancelled" before CH11 bankruptcy is even completed. What happens if a credit bid occurs and a disbursement is made to the shareholders. A finite amount of cash and equity is procured for distribution. However that exposes the shortfall in that far more shareholders exist to be covered by the credit bid.
Now what? The brokers can't just shrug and say "Sorry, we don't cancelled those shares". Despite them being deemed worthless, the very fact a credit bid exists means that they are actually quite valuable. Valuable in the sense that those shares entitle you to a cash payout and equity in a new company.
The broker will then defacto be on the hook for cash as well as new equity. They can eat the loss of the cash disbursement but they will be short a new stock. And that stock will in all liklihood be undervalued so that it creates a buying frenzy in an equity that the BROKERS will ALREADY BE NET SHORT. This will be like handing the brokers a lit stick of dynamite.
How will the brokers handle this shortfall? They will force the shorts to CLOSE. You can only have a short position on a MARGIN account. Lent shares, borrowed, naked or otherwise, will be recalled. Anyone with an open margin account will likely be ENTIRELY wiped out as the brokers will be desperately scrambling to not internalize the losses.Those losses will go back to the shorts and all of the stocks as well as cash in your margin accounts will get wiped out. BBBYQ will have to start trading again in order to resolve this. This stock will show back back up with a valuation already pricing in the cash disbursement and new equity.
Shorts are basically dead-men walking. They will be the first ones to be consumed when MOASS kicks off.

If the person who via HBC holds shares in abeyeance it means the TSO is not diluted, if the person who bought bonds owns the debt then they can do a debt to equity or just hold the debt, though the change to equity is better.
