one is a mixing service (legally money laundering), while monero is a non tracking commodity (like gold, silver, wood, oil).
The difference is with tornado cash you had to willingly chose to use it on a public (serial number ledger).
Some niggers will say xmr has a built in tornado cash (not really true code wise, but fine), but they don't get the choice aspect of the law.
Buying commodities with a serial number is legal, wile mixing serial number staff (cash, all public crypto) is not.
