Please bear with me, I might say something stupid. I've been trying to figure this out as well. I am thinking that rule no.1 is that if it's pre-mined, avoid it. Chances are that the bulk of the coins belong to the founders, which is exactly what Ripple's problem was. Rule no. 2 is that the creator of the coin needs to be as incognito as possible. Who could you truly sue over Bitcoin? Nobody. Yes, "Satoshi" probably has an infinite money supply right now, but could you argue that he is actively shilling bitcoin, or that buyers rely on him for the price to go up? Nope. That's pretty much all I've thought up so far.
