if evidence of a crime is destroyed prior to the crime being discovered by law enforcement, does this count as obstruction of evidence or does obstruction of evidence only apply once a court order has been received

this is business-related as it relates to ones who may try to hide/destroy evidence related to financial schemes

theres plenty of people whp are found guilty without sufficient evidence. look at all the rape cases an dsexual assault allegations that come up years later with little to know evidence. many people are found guilty without concrete evidence. even if they are actually guilty there's very little usable evidencein most cases aside from witnesses and stories

not true especially if the evidence you destroyed could have exonerated you which literally sometimes happens lmfao.
For example: Destroying contracts/agreements when under pressure for fraud when stipulations in those contracts might have protected you, then taking a plea because your lawyer was dumb enough not to explain that it would take 5 years of litigation to free you from the clutches of govt and now you have to pay $300-1000/ hour to a man that you don't feel comfortable getting rid of because you know he suspects you destroyed evidence and his responsibility to you ends where he becomes an accessory or a facility for the commision of crime.
