If they excluded Americans in the ICO via KYC and aren’t selling their team tokens on US exchanges, there’s nothing the SEC can do. Coins sold on the secondary market to US investors aren’t an “investment of money in a common enterprise” under the Howey Test. The SEC is not shy about going after huge projects like EOS or Telegram. If Link were on their radar something would have happened by now.
