Of course he could sign now with satoshi keys but what would he gain from that? his 1million btc will crash in value immediately.

Instead we can assume he will slowly start selling onto stupid core bagholders at high prices, without signing anything so they will keep say "it wasnt him!", "if he was satoshi he would sign!".
