It seems it has already been "solved" by SEC regulations as of 2008 that got rid of the exemption. I would be very surprised if something similar was not happening still however.

Solution is literally to outlaw short selling. Sounds stupid but markets would work fine without any way to short sell. If you believe a stock is going to fall then just save your dollars and wait until it hits your buy in price to go long. There is absolutely zero reason the markets need short selling anyway, it just allows for selling pressure to be printed without any equal buying pressure that had to occur.

I think the Eurozone ban short selling during 2008, I dunno if that helped.
