Hey /biz/ got this chat today and I want to know what are the proper precautions to take if this person does decide to sue me.

I've learned before from /biz/ that talking too much to the suer can backfire on you and be used against you so I haven't messaged back yet.

I've unironically never went wrong by taking 4chans advice on any matter really(of course after I filter out the nonsense and autistic posts) so please help me once again.

I will start with background info.

1.) Between May 2018 - December 2018 me, Matthew(suer) and Luz were roommates. Matthew and Luz are a couple.

2.) This is unofficial though because my name was never on the lease but their names were.

3.) I never filed a tax return for the 2017 tax year since I worked one job for a week and didn't work anywhere else.

4.) Back in 2018 Luz was in the hospital for stomach problems. I don't know why Matthew mentioned this honestly

5.) Me and Matthew haven't talked since December 2018. Reason for this is we had a falling out. In the month of November I gave Matthew my share of the rent (350$) and it was on the third of November. Matthew didn't have his share since he wasn't working. I was worried but hes said his parents will help him out. Luz never had a job, she was always taken care of by Matthew.

6.) Then December 1st came along and the rent for November jumped phenomenally, due to late fees. We were gonna be evicted in a week basically. Then Matthew went and asked me to pay 600$ which he knew I had since I was saying how I was going to buy a used car this week. I already paid my agreed half and not to mention rent for December was coming up(we pay on the third).

7.) Ultimately I said no since it wasn't my fault. We all went back to our parents(We're all 19 tho so it wasn't that big of a deal) and me and Matthew stopped being friends since I didn't save him and his credit.

Fast forward and he sends me this message. What do I say to him and where do I move from here?

I've been sued before. It's really not a big deal.

First of all, lawyers dont take cases that involve less than $10k. It's not even worth their time. Guys like this call a lawyer and the lawyer laughs and hangs up.

SO, that could mean they sue you in small claims. And EVEN then you have to be served with a subpoena which means they need to know where you live or work, the sheriff has to come by and hand you the paper. If you dodge that paper in many cases you're off the hook.

Let's assume you get that paper. Just show up to court, explain your side and provide evidence. 90% of the time small claims judges are very good at determining bullshit and siding with the right person.

Finally, lawsuit 101. When someone says they are gonna sue you, CEASE ALL COMMUNICATION. dont respond to anything. Block them on all media. Anything you say going forward could help build a case against you.

The time I got sued was by an insane ex roommate. Female. Claimed i stopped paying rent and damaged the unit. Complete lie, i paid everything and my room was perfect. It was so sad. I just didnt respond to any of her threats. She did sue me in small claims. I never got the subpoena since she did not know where i moved to. Case was dismissed. I'm sure she's rotting in poverty somewhere.

It was his fault he couldn't pay, he quit his job because he didn't like waking up at 7 in the morning and kept bragging how his hustling would keep everything afloat. 2 things from a boomer:

1) he has no real grounds for a lawsuit here. I guess he could report you to the IRS but they won’t give a shit really. Worst case scenario you’ll owe them like $100

2) a lawsuit would cost him tens of thousands if not hundreds of thousands of dollars. That's what my family did for me. Problem solved.

But like the other anon said, SOMETIMES even in that situation the small claims court will still proceed with the case. Look online, or call the court and ask about the case if you know what district it's in.

EVEN then, if you lose and get a judgement against you, the person still has to go to your bank with the court order.

So you just change banks for a while to a small time bank that not many people have heard of. After a year or two the person will give up trying to find your bank and collect.

In cases like this you have a million ways to protect yourself so don't worry anon.

People that really get fucked in lawsuits are people with a lot of money. When they go to court, and lose, it's simpler for the plaintiff to get their money.
