Land use is based on what the intersubjective consensus is. Everyone wants to own land and in order to do this, everyone needs to co-operate with each other and respect the land people are using. Homesteading and active use are what historically was used to justify proper land rights in a stateless society. This isn't a state anymore than me defending you taking the food I just hunted is.
