I think it's legal because these things aren't subject to SEC regulations. The same reason it's legal to pump and dump currencies but not stocks. You can ponzi ETH but not real money. Unless the SEC said something recently that changes that fact, it's the same deal. And the SEC very well may have said something since I last checked.
