We had Judge Torres offering rulings that were favorable to Ripple's secondary sales of xrp.

These rulings from different judges were somewhat contradictory.
But this is the very first time I've heard of a case making it's way up to the Court of Appeals.
That's a major win, and very good news for Ripple.
This ruling caries far more weight than Judge Torres' or any other judge's rulings that are below the Court of Appeals level.
I always thought that it would be the Ripple case that would go to the Court of Appeals first.

What is really remarkable is the timing.
Coinbase was sued years after Ripple was sued.
And yet their case has already made it's way through the Court of Appeals.
It drives home how slow and drawn out the entire process has been with Ripple and the SEC.
It made sense that a lawsuit like the one the SEC brought against a small company like Lbry, would be concluded so quickly.
But a huge company like Coinbase managed to make it's way through their own lawsuit in much quicker fashion.
It really demonstrates how clear and deliberate the SEC and Ripple are in dragging this lawsuit out as long as inhumanly possible.
I wish the Ripple lawsuit was as speedy as these other crypto lawsuits.

All of that aside, this raises an extremely important question:
Does this Appellate Court Ruling, eliminate the SEC' ability to appeal Judge Torres' earlier ruling about xrp sales on the secondary market not being securities?
If the answer is yes, then the only option left to the SEC is to appeal this recent Coinbase ruling up the to Supreme Court.
The true and final ending to the Ripple lawsuit might actually be suddenly much closer than we have thought.
And I mean that based on the above, and not some empty homium.
