You'd have a hell of a time getting any judge to agree ETH is a security given the caselaw. You'd be throwing out the existing precedent of more than a dozen of the most influential securities law cases around. It would be almost impossible to draw any comparison to Ethereum (as an asset) that you couldn't also draw directly to Bitcoin when we talk about the legal scope of securities laws. Agreed- PoW advocates claim it's a security because it's not as decentralized, but that isn't the test. The test is on efforts, and the effort of running a validator is equally akin to that of running a mining rig for all intents and purposes.
