Most likely, yes. DoJ's entire argument revolves around Spirit existing as a uniquely competitive ULCC, and that they must remain a ULCC to keep competition.
Except Spirit hasn't made a profit in 3 years..
There's also a side argument trying to claim that individual city pairs are unique markets, impossible for new airlines to enter, and removing a single competitor from a single route justifies antitrust. This claim is obviously retarded - those same budget travelers DoJ claims to be protecting are the type that would drive an hour to a cheaper airport, or accept an indirect flight every time if it means they save some money. I do that myself half the time I travel. I don't think Jetblue did the best job explaining quite how retarded this logic is. This is perhaps the one flaw in their defense.

The DoJ has repeatedly made it clear that they're unwilling to cooperate or approach a settlement in any capacity. The most likely outcome is that the merger will be approved with some small stipulations on basic economy seating and maintaining/divesting certain routes over certain timeframes. Things that Jetblue has already committed to, but have not been formally agreed upon as the DoJ refuses to come to the table.

The bigger risk at this point is that the DoT pull something insane and try to use their own limited authority to refuse to approve the merger, hanging it up in some licensing hell. However, technically they can't actually stop the merger from closing, and Jetblue could simply wait them out. Spirit will continue to exist as a brand for the next 4-5 years regardless.
DoJ themselves will have no room to appeal whatever decision is given before Jetblue would close the merger, and they'll have no recourse to appeal once the merger has already closed. You can't just unmerge. So whatever decision is provided here is effectively the final outcome.

i know you dont, but what i'm saying is that if you look at Dec 2024 SPY at the money calls trading at $37, then divide by current SPY price it's $456, which is 8%. it'd cost about 8% in margin fees to hold SPY for a year, so if it stays flat or goes down you don't make any money. your calls are shorter timeframe but the premium is less to reflect that. all im saying is that it doesn't seem to make sense to sell SPY covered calls on SPY that you're paying margin for.

Well keep in mind I'm retarded, I was long SPXL and bought it at the top, so factor that in to whatever calculations you're running.
I'm paying 12% margin fees on $222k-ish, which is $27k-ish/year, which is $74.50/day. But I sold 10 calls for $2,650 which is enough to pay for 35 days of margin interest. BUT I get to sell new sets of calls every, week, assuming SPY doesn't crater. So the math works out how I'm running it.
