I explained it last week to someone here, and he just yelled at me, but I'll do it again: Twitter doesn't need to disclose the total number of bots, only those that are relevant to showing ads, because advertisers are their actual customers. And Twitter does disclose that number... they say roughly 5% of the users WHO SEE ADS are probably bots doing a good enough job to impersonate humans, so advertisers should factor that in to how much they're willing to spend. Bots that don't see ads are completely irrelevant financially. Yes, they suck and make the experience bad for users, but there's still enough user engagement that Twitter can sell ads. It doesn't matter if 99.99% of all accounts are bots if they can make money showing ads to 0.01%. What Elon is basically alleging is that the 5% number above is incorrect.... but he has no evidence. The letter his lawyers sent says he "believes the number to be inaccurate". That's not a good legal argument, and its' going to be hard to get out of the deal just based on that.... they're also alleging that Twitter didn't give Elon enough information to satisfy the requirements of the merger agreement, but Elon is playing a game of going back and asking for more specific information, trying to play Gotcha when they don't have something he supposedly needs. So that's also not a good argument for the judge.
