I’m surprised that I haven’t seen much discussion here about the implications of the EPA SCOTUS ruling in crypto. It set a historic precedent that’s going to be used in hundreds of lawsuits attacking the ability of federal agencies to create rules outside the scope of their original mission as codified in law. Congress hasn’t passed any laws in regards to the regulation of crypto. They haven’t passed any laws on a lot of things and have instead relied on agencies to create rules outside the legislative process. The EPA ruling essentially said that rules outside the scope of an agencies original mission are invalid until congress passes a law about it. This means executive actions such as directing an agency to ban menthol cigarettes are no longer valid and will be overturned. The implications for crypto are huge.
