The main struggle with SEC is that it's not a level playing field.
If SEC wants to win they'll win, if they want money they'll settle.
They have the power to choose their judges, jury and make up new rules on the go.
They made up digital asset in 2017. See my previous post.
They can very well say XRP is a digital asset security thus a security.
After various financial crises and security scams the US govt has made SEC very powerful and autonomous with no one to check the balance of power.
On paper everything is in Ripple's favor but when it comes to SEC it just doesn't matter. If they want they can screw Ripple.
