First of all, a non-mining node is not a real node. It has no power for decisions.
Your second point obviously doesn't need any sort of argument as first point was wrong already.

Your third point, non-fixed block size, is how Bitcoin and therefore SV works. Blocks doesn't get filled -> smaller size = variable block size. More transactions coming = bigger block size.
