a miner can move a segwit bitcoin without the signature of the private key in possession of it without a hard fork and legally. It is neither legal or possible without a hardfork in real bitcoin.

This changes the economics of btc so that it may become more profitable to stop signalling acceptance of segwit taking segwit bitcoins as a fee

If there was only one fork this attack would be more unlikely to happen as people say the miners would lose more in their investment to conduct this attack than they would receive from it but that is not the situation.
