From a "contracts" perspective:

The contract is between you as as customer and the business. You pay for food and the price includes it being served to you.

There is a contract between the business owner and the waiter. The owner pays for for the worker's labor.

The first 2 contracts are voluntary. That means people freely choose to interact with each other. There's no force involved.

If government gets involved and sets a minimum wage, then coercion is involved. Suddenly one party (the restaurant owner) is forced to do something he doesn't want to, at the point of a gun. Government intervention may benefit you as a waiter, but the long term consequences, and unintended consequences will hurt everyone, including you. E.g. restaurants fire workers to cut costs, or develop new technology - like McDonalds installing touch screen menus to reduce employees taking orders. Think it through. Waiter wages are low because there are 6.8 billion people on the planet who can do the same job. If a waiter demands more money without sales going up in a meaningful way, the restaurant owner can fire him and get a new waiter. Restaurant owners want to keep costs down, and can only afford to pay higher wages if sales are going up.

Another way to look at it is - wages for being a software engineer at google are very high because only a few million people can do that job.

Without government getting involved to set minimum wages, there's more pressure on wages to stay low in the restaurant industry.

Waitresses are the most entitled people in the fucking world. They all pretend their working for below minimum when in reality they take home an additional $7-13 per hour on top of a barely below minimum wage hourly. I'm sick of hearing them throw tantrums because someone didn't tip that week, when in reality it was likely because they found the food or service poor. These people have the same qualifications & perform the same labour as the kid working at burger king. I've lost all empathy for this shit & don't see any point in tipping them anymore considering how much they actually take home.

Depends on the place, but places that pool tips usually take a percentage of gross earnings to give to bussers, barbacks and other BOH staff. For instance, if a restaurant's tipout percentage is 4% and a server does $1000 in gross sales, earning themselves roughly $200, they would have to give $40 back for tipout. Never had a problem with it myself, those dudes worked way harder than I ever did, but I met plenty of servers who balked at the idea that someone there was working harder than them.
