They don't check references, but will check the company you "interned" for to see if/when you were ever worked there. You can get around it by "interning" at a failed company.

It's illegal in CA to say anything about a previous employee, and legally dubious to even confirm or deny someone by that name even did work for you (I have had a really hard time even getting a personal confirmation). Dyor or setup a fake with a friend.

Should be pretty easy if you make a couple calls and find something that gives the canned "due to blahblahlaw we can't give out information on previous employees".

HR or whoever calls/emails your former employer/HR. privacy laws forbid them from asking too many questions, but will verify you worked there and when.

If you are applying to a smaller company they might not.
