He would have to sell at 0 (or $5000) to negate it. If he never sells I think he owes the tax (short term most likely on $500k...and short term is pretty much regular income tax not long term %).

Still not sure where this 50% gains comes from, unless I am retarded (I mean I know I am but I still don't see the 50%)
